1. Acceptance of Terms
By accessing or using Obsidian (“the Platform”), operated by Obsidian BV, you agree to be bound by these Terms of Service. If you do not agree, you must not use the Platform.
2. Description of Service
Obsidian is a business management platform that provides tools for business management, invoicing, and CRM. We reserve the right to modify, suspend, or discontinue any part of the service at any time.
3. User Accounts
To use the Platform, you may be required to create an account. You are responsible for:
- Providing accurate and complete registration information.
- Maintaining the confidentiality of your login credentials.
- All activity that occurs under your account.
You must notify us immediately at info@obsidian.be if you suspect unauthorised use of your account.
4. Acceptable Use
You agree not to use the Platform to:
- Violate any applicable law or regulation.
- Infringe upon the rights of others.
- Upload malicious software or attempt to compromise the security of the Platform.
- Interfere with or disrupt the operation of the Platform.
- Collect or harvest data from other users without their consent.
5. Intellectual Property
All content, design, and software comprising the Platform are the property of Obsidian BV or its licensors and are protected by copyright and intellectual property laws. You may not reproduce, modify, or distribute any part of the Platform without prior written permission.
6. Data and Privacy
Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.
7. Limitation of Liability
To the maximum extent permitted by Belgian and EU law:
- The Platform is provided “as is” without warranties of any kind, express or implied.
- We shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform.
- Our total liability for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim, or €100, whichever is greater.
8. Termination
We may suspend or terminate your access to the Platform at our discretion if you violate these terms. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (including limitation of liability, intellectual property, and governing law) shall remain in effect.
9. Changes to These Terms
We may update these terms from time to time. Material changes will be communicated via the Platform or by email. Continued use of the Platform after changes constitutes acceptance of the revised terms.
10. Governing Law and Jurisdiction
These terms are governed by and construed in accordance with the laws of Belgium. Any disputes arising from these terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Antwerpen, Belgium.
